ANOKHI REET – DAMAGE & LIABILITY POLICY

I. Policy Overview

This Damage Policy governs all matters relating to damage, loss, misuse, or alteration of outfits listed and rented through Anokhi Reet.

By accessing or using the platform, users agree to this policy along with the Terms & Conditions and Privacy Policy.

II. Independent User Transactions

Anokhi Reet is a technology platform that enables users to connect.

• Anokhi Reet is not a party to any rental agreement
• Anokhi Reet does not facilitate, control, or participate in transactions
• Anokhi Reet has no involvement in product handling, exchange, or return

All rentals are independent, private arrangements between users.

III. No Custody, No Control

At no point does Anokhi Reet:

• Take possession of any outfit
• Inspect, verify, or guarantee product condition
• Monitor how items are used
• Supervise delivery, return, or handling

Accordingly, Anokhi Reet has no control over and no responsibility for the condition of any item at any stage.

IV. Assumption of Risk

By participating in any rental (as Owner or Renter), users expressly acknowledge and agree that:

• Renting clothing involves inherent risks, including damage or loss
• All such risks are fully and voluntarily assumed by the users
• Use of the platform is entirely at the user's own discretion and risk

V. Renter Obligations

• To use the outfit responsibly and with reasonable care
• Not to damage, alter, or misuse the outfit
• To return the outfit in the condition agreed with the Owner

• Any damage (whether minor, major, intentional, or accidental)
• Stains, tears, burns, or deterioration
• Missing items or components
• Unauthorized alterations
• Loss, theft, or failure to return

VI. Owner Rights

The Owner retains full authority to:

• Define usage conditions
• Determine acceptable return condition
• Assess whether damage has occurred
• Decide compensation or recovery terms

All such determinations are solely between the Owner and Renter.

VII. Financial Responsibility

Any compensation relating to damage, loss, or non-return:

• Is decided mutually between users
• Is handled entirely outside the platform
• Is not facilitated, processed, or enforced by Anokhi Reet

• Payment collection
• Refunds
• Compensation disputes

VIII. No Liability of Anokhi Reet

To the fullest extent permitted under applicable Indian law, Anokhi Reet, its owners, operators, employees, or affiliates shall not be liable for:

• Any damage to outfits
• Loss, theft, or non-return
• Misrepresentation of listings
• Disputes between users
• Financial or indirect losses arising from rentals

This applies regardless of the nature of the claim, including negligence, breach, or otherwise.

IX. No Obligation to Intervene

Anokhi Reet:

• Does not mediate disputes
• Does not investigate claims
• Does not enforce agreements or outcomes

Any assistance provided (if any) is purely discretionary and does not create responsibility.

X. Indemnity

Users agree to indemnify and hold harmless Anokhi Reet from any claims, damages, losses, liabilities, or legal expenses arising from:

• Damage to any outfit
• Disputes between users
• Misuse of the platform
• Breach of agreements between users

XI. Limitation of Platform Responsibility

Even if Anokhi Reet is notified of a dispute, complaint, or damage:

• It shall not be obligated to act
• It shall not be liable for any outcome

Platform access is provided strictly on an "as-is" and "as-available" basis.

XII. Enforcement Rights (Platform Protection)

Without assuming liability, Anokhi Reet reserves the right to:

• Suspend or terminate accounts
• Remove listings
• Restrict access

In cases of misuse, complaints, or policy violations.

XIII. Legal Jurisdiction

This policy shall be governed by the laws of India. Any disputes related to platform use shall fall under Indian jurisdiction.

XIV. Final Acknowledgment

By using Anokhi Reet, users confirm that:

• They understand Anokhi Reet is only a connecting platform
• They accept full responsibility for all rental-related risks
• They waive any claims against Anokhi Reet arising from damage, loss, or disputes
